Also, in order to benefit from certain services offered through the Site, you must create a user account, on which occasion by checking the "I agree to the Terms and Conditions" field you will also express your express consent.
The terms and conditions apply to all users of the site (hereinafter "users") and take precedence over any other agreements between them and BOTANICAL SRL.
If we become aware of any fraudulent activity or behavior in your use of the Site, we reserve the right to suspend, restrict or terminate your access to the Site at any time without prior notice.
BOTANICAL SRL has the exclusive right to change the Terms and Conditions at any time and without prior notice, and it is your responsibility to review them periodically.

To use certain services you need to create an account and log in.
To create an account you will need to enter your name, an e-mail address and set up a password (we recommend that you create a strong password, containing at least one uppercase letter, one character and one digit - e.g. passwordIMarSkin10#).
After entering your e-mail address and setting up a password, you will receive a link in your e-mail with which you need to confirm the account creation. If the confirmation and verification process has been successfully completed, your account will be activated and you can log in using the e-mail address and password you entered when creating your account.

If you log in to the site using your Facebook account, we use account information such as your name, profile picture and e-mail address. However, the information collected may differ depending on the privacy policies or settings for those accounts. In order to verify what information you will share with us before you use your Facebook account, we recommend that you click "Continue as Facebook" -> "Edit the info you provide", edit the information and only then click "Continue as your Facebook account name".
We need access to the photos, media and files stored on your device in order to be able to change your profile picture in the "My Account" section to an existing photo on your device.
BOTANICAL SRL grants the User a free, non-exclusive, non-transferable, non-sublicensable license, without the right to sublicense, on the territory of Romania, in accordance with this Agreement.
The User shall not have the right to redistribute all or part of the license granted by this Agreement. The granting of the license by BOTANICAL SRL is conditioned upon the User's continued compliance with all limitations, restrictions and other terms of the license in this Agreement. In the event of breach by the User of any of the limitations, restrictions or other terms set forth in the Agreement, the license grant shall automatically and immediately terminate, without BOTANICAL SRL owing any damages or compensation of any kind. The license descriptions in this section define the scope of the rights granted to the User by BOTANICAL SRL. Any use of the Site outside the scope of the license or in a manner not in accordance with this Agreement constitutes a violation of BOTANICAL SRL's intellectual property rights and a breach of this Agreement.
If BOTANICAL SRL develops an improved version of the site previously licensed to the User, the license right previously granted will continue.
The website may be used subject to the following technical conditions:

- Browsers: Chrome, Firefox, Safari, Internet Explorer, Edge
- Internet access.
In order to be able to use the website and access the services offered through it, the User must have a technical device (e.g. cell phone, laptop) that meets the requirements listed above. BOTANICAL SRL does not guarantee the compatibility of your device with the Website. In order to use the Website, your device must have internet access, and the User shall bear any costs necessary for this purpose.
It is forbidden to read, copy or manipulate in any way the source code of the site, by any electronic and computerized means. Any non-compliance will immediately lead to the prohibition of the use of the site and services, the User shall bear the costs of any resulting damages.
The user is obliged to immediately inform BOTANICAL SRL about the loss or destruction of the device used to access the site, so that it can block the account and prevent unauthorized use of the site, which contains personal data (including partial data on the bank card used to pay for the products - for more information, check the "Payment by card" section. The user will be informed by email about the blocking of the account. The User will be liable for any damage caused to BOTANICAL SRL and/or any of its other collaborators by failure to notify the device, in particular if, as a result of such loss, theft or misuse of the website was possible.
The Services offered through the Website are addressed to the Users and may only be used in accordance with this Agreement.
By using the Website, the User certifies that he/she is 18 years of age or, in the case of minors between 14-18 years of age, that he/she has obtained parental consent for this purpose.
We recommend parents to instruct their minor children not to transmit their data on the internet.
However, persons over 14 years of age may order products displayed on the website, but only with parental consent. Thus, parents are responsible for the transmission of personal data of minors to BOTANICAL SRL. They are also responsible for the transmission of data related to the bank card used to make a payment on the site.
To place orders through the website it is necessary to create an account. To place an order you will be asked for the following information (if you have not already entered it): phone number, delivery address details, payment method.
BOTANICAL SRL considers the information provided by you to be accurate, complete and current.

The terms and conditions of the website represent the provisions of the Contract between you and BOTANICAL SRL.
Object of the Contract (i) the sale of products, subject to stock availability; (ii) the provision of services.
Price The contract is the price of sale of the products displayed on the website and included in the order validated by confirmation by BOTANICAL SRL.
The order placed by the User is considered accepted by BOTANICAL SRL when the User receives a confirmation from BOTANICAL SRL indicating that the products are in stock and are to be shipped. In this regard, a confirmation from the User of receipt of this e-mail is not necessary.
Prices displayed on the website are in Ron (lei) and include VAT (value added tax). BOTANICAL SRL reserves the right to modify the displayed prices at any time.
The contract is considered concluded between BOTANICAL SRL and the User at the moment of receipt by the User from BOTANICAL SRL, via e-mail and / or SMS notification of shipment of the order.
The user can place orders through the site, by adding the desired products in the shopping cart, and finalize the order after completing the steps indicated on the site. By finalizing the order, the User agrees that all data provided by the User, necessary for the purchase process, are correct, complete and true at the time of placing the order.

- Choose the products you want
Once you find a product you want, go to the product page, select the quantity and click the "Add to cart" button.
- Shopping basket
After adding the product to the cart, click the "Cart" button, where you can edit the quantity of the selected products.
- Delivery dates
Once you check the products, quantity and price you have to pay and agree to them, click the "Continue" button. Fill in the requested information in the newly opened window. To the extent that you have previously filled in this information in the "My Account" section, you only need to confirm the data entered.
- Order finalization
Once you have gone through the previous steps, make sure again that the products in your shopping cart are the ones you have selected, and then press the "Place order" button.
After this step you will receive a confirmation e-mail containing the order details.
Currently, we offer Customers two ways to pay the price of the products (Contract Price), i.e. payment on delivery (cash on delivery) or payment by credit card (online, via the internet).
If you have chosen to pay by cash on delivery, you will pay for the products upon delivery by the courier company's agents. This payment method is not available for international orders, where you can only pay by credit card or bank transfer.
Ordered products can also be paid online by credit card, payments are processed through the mobilPay processor (Netopia S.R.L.). For more details about the service offered by mobilPay, please refer to the Terms and Conditions posted on http://www.mobilpay.ro/terms.
Part of the information related to your card is processed by BOTANICAL SRL. Thus, we store only the reference to the card with a code, expiration date, first and last 4 digits. The rest of the data is processed by mobilPay.
If you wish to make payment by bank transfer, please note that you must contact us, because at this time the website does not technically allow the launch and finalization of the order in this situation.

So, once you have contacted us and we have confirmed that we have the products, before we send them to you, please make the payment of the amount communicated, using one of the accounts below.
After payment, please send us the payment order, and we will deliver the ordered products as soon as possible.

The delivery of ordered products is made through the courier company GLS General Logistics Systems Romania S.R.L. (hereinafter "GLS Romania" or "GLS"). The payment for the transportation service is paid separately from the order price, directly to the courier.
Thus, the cost of orders sent within Romania is between 17 lei and 20 lei, depending on the delivery area and is paid separately upon receipt of the order, if you have opted for online payment of the order. If you have opted for payment by cash on delivery, the price that the courier will communicate to you is composed of the price displayed when you placed your order + the cost of transportation.
In case of orders from EU Member States or from outside the EU, the transportation cost is 120 lei, and the shipment will be made through the courier company DHL International Romania S.R.L. (hereinafter "DHL").
For non-EU countries, customs duty is payable separately upon collection of the package by the recipient. You will be contacted by a DHL representative (usually by e-mail) who will give you all the necessary information.
According to the legal provisions, when you buy through the website, you have the possibility to withdraw from the Contract within 14 days after delivery of the products, without providing a reason.

When you withdraw from the Contract, we will refund you the purchase cost of the products and the delivery costs within 14 days from the date of withdrawal. However, we note that we will refund the money after returning the products.
For reimbursement purposes, we will use the same method of payment that you used to pay for the cost of the goods and services, unless we agree otherwise later.
When you exercise this right, you must send the products immediately, but no later than 14 days after the date of withdrawal, to the following address:

Please note that all costs associated with the return of the products will be borne by you unless we agree other terms with you.
It is very important to note that you are held responsible for any decrease in the value of the products.
The right to withdraw from the contract is not applicable in the following situations:
- Products are made according to your requirements;
- If you have opened the packaging of cosmetic preparations and/or other products that come into direct contact with the skin.
BOTANICAL SRL will ensure proper packaging of the products and transmission of accompanying documents (invoice, delivery documents).
The turnaround and delivery time of your order can vary from one to five business days, depending on both the scheduling of the forms in the lab and the availability of the courier company. In the case of courier companies, we mention that the aforementioned deadline may be exceeded, and we are unable to manage the actual delivery of the product after the delivery to the courier.
Also, during PROMOTIONS displayed through the website, the aforementioned term may be longer, being influenced primarily by the manufacturing time of the products as well as the number of orders.
Delivery of orders is ensured by courier companies, both within Romania and in the Member States of the European Union ("EU") and outside the EU, in Qatar, USA, etc. by DHL. Once delivered, the parcels become the responsibility of the courier companies. BOTANICAL SRL is not responsible for any loss or damage occurring during the transportation process.
Unless otherwise stated, only one promotional code can be used per order and the code cannot be added after the order has been placed. Promo code can be used as per the campaign displayed unless otherwise stated. Please see individual offers for further details. Please note that some PROMOTIONS are country specific and not available in all territories.

The user is fully responsible for ordering and using the products, especially if there is no possibility of traveling and consultation beforehand. Products may contain Vitamin A and derivatives, flower or fruit acids, AHAs or depigmentation substances that may temporarily sensitize the epidermis.
BOTANICAL SRL informs the User through this clause that the packaging of the products may differ from one product to another, and the photo displayed on the site is for informational purposes only.
Because we want to preserve the freshness of our products, they are manufactured in small batches. We therefore inform you that there may be differences in texture and color between products, depending on the batch to which they belong. The differences are influenced by the active substances used, which are natural (e.g. the color of coconut oil may differ depending on the season and the area where the raw material comes from).
Because BOTANICAL SRL products contain allergens, before unsealing and using them, we recommend that you carefully read the ingredients they contain, and to the extent that you know you are allergic to any of the ingredients, do not use the product.
However, if you experience an allergic reaction (e.g. skin irritation), stop using the product immediately and consult your doctor.
We also mention that the formulas for the realization of the products may be modified from the original recipe, by enriching it with new active ingredients designed to increase the effectiveness of the products. Therefore, before using the product, we recommend that you carefully read the ingredients it contains and if you are allergic to any of the ingredients, do not use the product.
BOTANICAL SRL products are cosmetic treatments which do not replace the advice of a specialist and whose use is not guaranteed in all cases to obtain the desired results.
Although the ingredients used to manufacture the products are of the highest quality, and the vast majority of customers have very good results, the results may differ from case to case, as each body reacts differently.
Results may also be influenced by hormonal or other conditions of the user.
BOTANICAL SRL disclaims any liability arising out of any implied or implied warranty as to the results that may be obtained by using the products. This clause in no way limits your rights conferred by law.

It is also prohibited any use of the website, information and data provided to the User for purposes other than those related to the fulfillment of your obligations.

The site is secure, with the following technical and organizational measures in place:

10.1.1. Individuals - consumers
In order to resolve any disagreements between you, as a consumer, and BOTANICAL SRL, as a seller, arising from the Contract, we inform you that you can resort to the European Online Dispute Resolution platform.
The European Online Dispute Resolution (ODR) platform is provided by the European Commission to increase the safety and fairness of online shopping by providing access to quality tools for resolving disputes.

In order to resolve any possible disagreements between you, as a consumer and BOTANICAL SRL, as a seller, resulting from the Contract, we inform you that you can file a complaint with the National Authority for Consumer Protection.

10.1.2. Legal entities
In order to resolve any possible disagreements between you and BOTANICAL SRL, we kindly ask you to contact us in order to resolve them amicably. To the extent that the Parties do not reach an agreement, the court with territorial jurisdiction shall be the court of BOTANICAL SRL.
This Contract shall be concluded in the Romanian language and shall be governed by Romanian law.
