IMAR SKIN Loyalty Program (hereinafter referred to as "IMAR SKIN Loyalty Program") is a program administered by BOTANICAL SRL with registered office at 51A Rudului Street, Ploiești, Prahova County, 100024, Romania, with C.U.I. 46817291, tax attribute RO, Trade Register registration number J29/2668/2022. Depending on the number of purchases made on www.imaskin.ro, www.beautyceutic.com, www.skinopharm and/or www.maisonolfactif.com, this program entitles you to benefits and/or exclusive offers.
The IMAR SKIN Loyalty Program includes:
- IMAR SKIN Elite Gold program
The IMAR SKIN Loyalty Program entitles members to a physical loyalty card (hereinafter referred to as the "Loyalty Card"). This is a "Gold" Card within the IMAR SKIN Elite Gold program.
The IMAR SKIN Loyalty Program is addressed to persons who have a postal address in Romania (domicile or residence, even temporary) or the E.U., U.K. and who comply with the provisions of these terms and conditions, including who have provided certain personal data, as provided in the "Personal Data" article of these terms and conditions and who are IMAR SKIN customers.
The IMAR SKIN Loyalty Program is addressed to people who are at least 18 years of age on the date of enrollment in the program.
IMAR SKIN reserves the right to request at any time a document proving the identity of persons who wish to enroll or who have enrolled in the IMAR SKIN Loyalty Program, in particular in case of duplicate names.
CONDITIONS FOR OBTAINING IMAR SKIN Elite Gold CARD
The IMAR SKIN Elite Gold card is available free of charge to Elite customers upon request. It can be obtained by placing orders on the imarskin.ro website, www.beautyceutic.com, skinopharm.ro or www.maisonolfactif.com. In order to enroll in the program it is necessary to assign personal data such as name, contact phone number. The card is sent to members, to the mailing address provided, when the first online order is placed on imarskin.ro, www.beautyceutic.com, www.skinopharm.ro or maisonolfactif.com after the customer has been notified that he/she is eligible to receive the card.
Personal information is processed in accordance with the "Personal Data" article of these Terms and Conditions. Enrolment in the IMAR SKIN Loyalty Program can only be registered if the information provided at the time of registration or ordering on imarskin.ro, www.beautyceutic.com, www.skinopharm.ro or www.maisonolfactif.com is complete, in the required format and usable. It is the responsibility of each member to update their information. In any case, BOTANICAL SRL cannot be held liable if the member does not receive an offer due to outdated or inaccurate information.
Botanical SRL reserves the right to change the conditions for issuing the IMAR SKIN Elite Gold Card at any time.
CARD GOLD ELITE MEMBER LOYALTY PROGRAM CONDITIONS OF USE
Imar Skin Loyalty Program cards are nominal, personal and reserved for individuals for their own use, the cards cannot be used for purchases made by legal entities. They are non-transferable and in no way represent payment cards.
There can be no more than one Loyalty Card for the same person (same first name, last name, address, e-mail and/or SMS), and the associated benefits cannot be cumulated. Botanical SRL reserves the right to carry out any verification to examine the validity of the registration. In the event that Botanical SRL finds that the same person holds more than one CARD GOLD ELITE MEMBER Loyalty Program Card, the member's data and benefits will be registered only once on the same Card and the additional cards will be deactivated and the duplicate benefits will be removed. It is specified that a member can always access his/her customer space in the imarskin.ro online store or by calling the customer service, phone number + 40219928 (normal rate number).
Members agree to use the CARD GOLD ELITE MEMBER Loyalty Program in accordance with these General Terms and Conditions. If not, Botanical SRL reserves the right to suspend or close the Member's Loyalty account, to deactivate or remove the points, benefits on the Loyalty Card or Cards, under the conditions stipulated in the Article "Suspension / Deactivation / Loss of benefits".
CARD GOLD ELITE MEMBER LOYALTY PROGRAM BENEFITS
The GOLD ELITE MEMBER card GOLD ELITE MEMBER allows its holder, upon presentation, to benefit from a 10% discount in the concept-store in General H.M. Berthelot, 21A, bl. 1, ap. 3. parter, sector 1, București,, Romania and on the websites imarskin.ro and maisonolfactif.com.
The cardholder benefits from the discount from the moment of receiving the card in physical format and can access the discount using as a form of identification the name, surname and telephone number assigned to the cardholder.
Benefits cannot be transferred or exchanged for their cash equivalent.
In the case of a return request in the concept-store at str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, Bucharest or on the website imarskin.ro, maisonolfactif.com, Botanical SRL reserves the right to reduce the benefits accrued on the Loyalty Program card whose refund is requested.
The number of shopping days and the number of accumulated benefits can be consulted:

BIRTHDAY DISCOUNT
As a holder of the Elite Gold card and a member of the Elite Group, you get a 50% discount on your birthday.
Proof of your birthday is required to qualify for the discount.
The discount is also available on your first purchases after you have become a member of the Elite Gold group and are a Gold card holder.
The discount is granted once a year and is not cumulative with other discounts, promotions, rebates.
The discount is granted exclusively in the month of the birthday.
The benefits offered to the holder of a Loyalty Program card may vary according to the information submitted by the cardholder and his/her communication preferences (postal address and/or email and/or SMS). In this context, it is expressly specified that the receipt of certain benefits is linked to the means of communication chosen by the member.
PERSONAL DATA
Botanical SRL collects the member's personal data when registering in the Loyalty Program on the imarskin.ro website or in the showroom in General H.M. Berthelot, str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, Bucharest.
This information is collected by the sales consultant in the showroom, through the registration program, or through the imarskin.ro website.
When the customer already has an account on the imarskin.ro website and wishes to enroll in the GOLD ELITE MEMBER Loyalty Program, he/she must check with a Botanical SRL representative if he/she is eligible for enrollment. The online account data declared when creating the account is used for enrollment in the mentioned Loyalty Program under the conditions set forth in this General Terms and Conditions document, as well as in accordance with the terms of the Privacy Policy. In addition, the member can use his/her Loyalty Card for purchases in the concept store in Baneasa Shopping City, Romania or online to benefit from its advantages on the imarskin.ro or maisonolfactif.com websites. Therefore, the member must enter the unique discount code associated with the Fidelity Card when making a transaction on imarskin.ro or maisonolfactif.com and specify the phone number and name associated with the card for purchases in the concept showroom in str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, Bucharest.

The e-mail address and/or telephone number and/or postal address are requested by Botanical SRL at the time of registration, in order to send the customer, depending on the chosen communication channel, information regarding the card, the benefits related to the use of the card (including existing promotions or new products and services available in stores or online).
Afterwards, accessing the benefits, both on the website imarskin.ro and maisonolfactif.com, and in the showroom in General H.M. Berthelot str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, București can be made only with the discount code associated with the card (for online purchases), respectively the name and telephone number (for purchases in the showroom in str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, București).
PURPOSE AND LEGAL BASIS
Information regarding the history of member purchases and utilization of services is processed in this way by BOTANICAL SRL:
the data provided by the person concerned in order to register in the IMAR SKIN Loyalty Program are processed pursuant to the execution of a contract (acceptance of the Terms and Conditions of the IMAR SKIN Loyalty Program and participation in this program is equivalent to the execution of a contract);
- the data resulting from the data subject's choice of communication channel(s) are processed on the basis of that person's consent;
- data resulting from accessing the website imarskin.ro and maisonolfactif.com and data resulting from other checks on the validity of registrations in the Imar Skin Loyalty Program are processed on the basis of the legitimate interest of Botanical SRL, in order to organize and administer the Imar Skin Loyalty Program;
- data resulting from the use of our services are processed on the basis of the legitimate interest of Botanical SRL, in order to personalize marketing and advertising communications according to the preferences of the person concerned.
We ensure that we take into account the potential impact that the use of your data could have on you and on users of the Site in general. If we find that your interests or your fundamental rights and freedoms override our legitimate interest, we will not use your personal data on this legal ground and we will ask for your consent for processing.
STORAGE PERIOD
Information on members is kept by BOTANICAL SRL for a period not exceeding the time necessary for the purposes for which it was collected, during the period of membership in the Imar Skin Loyalty Program, plus the applicable statute of limitations in particular for the purposes of keeping proof of transactions and to enable BOTANICAL SRL to fulfill its legal obligations, after which it is deleted, archived to fulfill our legal obligations, or anonymized for studies and statistics, as appropriate.
Your personal data processed for the purposes of the IMAR SKIN Loyalty Program and the IMAR SKIN Loyalty Account (if you have such an account), will be deleted if:
You decide to leave the IMAR SKIN Loyalty Program.

Stop using the IMAR SKIN Loyalty Program
We will consider that you no longer use the IMAR SKIN Loyalty Program if you meet the following two cumulative criteria:
You have not made any purchases at IMAR SKIN using your Loyalty Card in the last year;

You have stopped interacting with BOTANICAL SRL this year, you have not used your card code.
If BOTANICAL SRL processes data on the basis of the legitimate interest of BOTANICAL SRL, the data will be kept for the period of the legitimate interest, but not more than 3 years after the last interaction you had with us, after which it is archived to fulfill our legal obligations, or anonymized for studies and statistics.
If BOTANICA SRL processes data on the basis of your consent, the data will be kept until your consent is withdrawn, but no more than 3 years after your last interaction with us, after which it is archived to fulfill our legal obligations, or anonymized for studies and statistics.
TARGET
This information is shared with our affiliates and all of our collaborators, employees in the management of our Loyalty Program, and service providers.

DATA TRANSFERS OUTSIDE THE EUROPEAN UNION

The member can also exercise his/her rights of access, deletion and portability:

RIGHTS RESERVED FOR BOTANICALSRL
BOTANICALSRL reserves the right to modify the General Terms and Conditions and to inform the member about any changes by the most appropriate means (letter, e-mail, updating the new General Terms and Conditions on the imarskin.ro website, etc).
The most recent version of the general terms and conditions of the IMAR SKIN Loyalty Program is the one that can be consulted on the imarskin.ro website. BOTANICAL SRL thus invites members to regularly consult the imarskin.ro website.
BOTANICAL SRL also reserves the right to modify or suspend the IMAR SKIN Loyalty Program.
It should be noted that in case of permanent termination of the IMAR SKIN Loyalty Program or its complete restructuring, which implies the loss of valid offers and/or purchase days and/or points accumulated, members will be informed by a means considered by BOTANICAL SRL as the most appropriate (letter, e-mail, Whatsapp or SMS, etc.).
In addition, BOTANICAL SRL cannot guarantee that accrued and unused benefits will be reused in any form in the event of a program modification.
BOTANICAL SRL reserves the right not to contact members who are not active in the IMAR SKIN Loyalty Program (i.e. those who have not made a purchase for more than 12 months by presenting their GOLD ELITE MEMBER Loyalty Card) to inform about any changes to the program.
Any update, modification or deletion of the IMAR SKIN Loyalty Program will not entitle members to compensation.
SUSPENSION / DEACTIVATION / LOSS OF BENEFITS
The IMAR SKIN Loyalty Program is a program that aims to provide benefits to members depending on the purchases made on the website imarskin.ro and maisonolfactif.com, and in the showroom in General H.M. Berthelot, str. General H.M. Berthelot, nr. 21A, bl. 1, ap. 3. parter, sector 1, București, Romania. Consequently, if the member does not make any purchase using his IMAR SKIN Loyalty Card for a period of 12 consecutive months, the accumulated benefits are lost.
The IMAR SKIN Loyalty Program assumes, in addition, that the member complies with the general terms and conditions of the program and presents an honest behavior towards BOTANICAL SRL. Consequently, BOTANICAL SRL reserves the right to suspend the IMAR SKIN Loyalty Program, even to permanently deactivate a Loyalty Card and, if necessary, to cancel the related benefits in case of a bad faith use of the IMAR SKIN Loyalty Program and/or towards BOTANICAL SRL.
BOTANICAL SRL will execute this suspension and / or deactivation after notifying the member affected by it by the means that will seem the most appropriate, without the member can seek compensation, especially in the following cases:
in the event of fraud, attempted fraud or theft in the concept-store and/or on the imarskin.ro or maisonolfactif.com website;
in case of misuse or misappropriation of the IMAR SKIN Loyalty Program;
in case of acts that may affect the functioning of the website imarskin.ro or maisonolfactif.com, the functioning of the IMAR SKIN Loyalty Program or the functioning of the concept-store;
in case of acts that may affect the functioning of the website imarskin.ro or maisonolfactif.com, the functioning of the IMAR SKIN Loyalty Program or the functioning of the concept-store;
in case of an abnormally large number of transactions on the same shopping day and/or several days,
if a payment incident has not been remedied within a period of one month from the notification made by BOTANICAL SRL;
more generally, in case of breach of the provisions stipulated in this General Terms and Conditions document.
RASPUNDEREA
BOTANICAL SRL is exonerated from any liability for any direct or indirect consequences of possible malfunctions of the IMAR SKIN Loyalty Program. However, in the event of a malfunction, BOTANICAL SRL will make every effort so that the member can keep the benefits related to the accumulation of purchase days and points.
Finally, in case of loss or theft of the IMAR SKIN Loyalty Card, the IMAR SKIN Customer Service must be notified, which is accessible Monday through Friday, between 09:00 - 18:00, by phone 0219928 (normal rate number), email hello@imarskin.com. A new code will be activated as soon as possible and will give the holder access to the related benefits.

Art. 1 - Organizer
BOTANICAL SRL (hereinafter "Imar Skin"), with registered office in Tatarani, Trandafirilor Street, no. 7, Postal Code 107059, Prahova County, order number in the Trade Register J29/2668/2022, fiscal registration code RO 46817291, legally represented by Ioana Marinescu - General Manager.
Art. 2 - Duration and venue of the Campaign
The campaign is organized and will run from 01.12.2023 - 31.12.2024 on www.imarskin.ro.
Art. 3 - Official Campaign Rules
3.1. The official rules of the Campaign are available to any applicant, free of charge, for the entire duration in electronic format, on the Imar Skin website (www.imarskin.ro).
The campaign is active only for customers who place online orders on imarskin.ro.
3.2 According to the free decision of the Organizer, the Campaign may be publicized in order to inform the public, including by means of advertising and/or informative materials. The information that such materials may contain shall be interpreted in accordance with the provisions of these Rules.
Art. 4 - Right to participate
4.1 The Campaign is open to individuals or legal entities ("Participants") domiciled or residing, respectively headquartered in Romania or who, in the case of remote purchases, can indicate a delivery address in Romania.
4.2 The Organizer reserves the right to cancel at its sole discretion the participation of any person who fails to comply with the Rules, who is suspected of fraud, who acts in an unethical or disruptive manner or who is determined to be acting with the intent to annoy, abuse, threaten or harass any person, without the obligation to prove it with evidence.

The offer is not cumulative with other promotions/benefits and is offered while stocks last.
5.2 The offer is only available on www.imarskin.ro , subject to stock availability, valid for loyalty card holders.
5.3 Participants will be able to purchase the products for personal use only, not to be remarketed.
5.4 The offer is not cumulative with other offers in the Imar showroom in Romania, on the website www.imarskin.ro or obtained as a result of holding a loyalty card.
Art. 6 - Return conditions
6.1. The return of purchased products will be made in compliance with the return conditions available on www.imarskin.ro.
6.2. The cash value of the discount will not be granted.
6.3 In the event that the customer opts to replace the product purchased under the Campaign, the new product that replaces it will no longer benefit from that offer, unless it is itself the subject of a Campaign or special offer. For the sake of clarity, at the time of replacement, the price valid on the date of replacement shall apply to the new product.
Art.7 - Limitation of liability
7.1 The organizer is entitled to take all necessary measures in case of any attempts to defraud the system, abuse or any other attempts that could damage the image of this campaign.
7.2 The organizer is exempt from liability in case of force majeure or fortuitous event, according to the provisions of Article 1351 of the Civil Code.
7.3 For the purpose of these regulations, force majeure means any event beyond the control, remedy or foreseeability of the Organizer, the occurrence of which renders the Organizer unable to perform its obligations under these regulations. These events include, but are not limited to: wars, fires, floods, strikes and blockades, earthquakes, other catastrophes of any kind, as well as any regulation that may prohibit or modify the terms of the Regulation. If, for any reason, this Campaign is not capable of running as planned due to causes beyond the control of the Organizer, fraud, technical problems, or any other causes which, in the opinion of the Organizer, corrupt or impair the administration, security, fairness, integrity or proper conduct of the Campaign, the Organizer reserves the right to cancel, terminate, modify or suspend the Campaign. In the event that the Campaign is terminated due to force majeure, fraud or technical difficulties before the end of the Campaign Period, an official announcement will be made at the Campaign location.
7.4 The Organizer shall not be liable for delays in the delivery of the products caused by delays in the provision of services by its suppliers, courier services, etc.
Art 8. FINAL PROVISIONS
8.1 By purchasing a product participating in the Campaign, participants agree to respect and comply with all provisions, terms and conditions of these Rules.
8.2. BOTANICAL S.R.L. reserves the right to amend these Rules by additional act whenever necessary, with the publication of the additional act on the official website of the Organizer, namely www.imarskin.ro , and making it available to customers.
8.3. Any complaint related to the running of the Campaign shall be addressed in writing to the Organizer at the registered office address specified in these Rules, within 14 (fourteen) working days from the date of completion of the Campaign covered by these Rules.
8.4 Any disputes arising between the Organizer and the participants in the Campaign will be settled amicably or, if this is not possible, by the competent courts.
